05         Presented for consideration is Ordinance No. 86 of the Municipality of San Isidro, Leyte, entitled, “AN ORDINANCE BANNING ILLEGAL SETTLEMENTS, RELOCATION AND OR REINTEGRATION OF INFORMAL SETTLERS IN THE MUNICIPALITY OF SAN ISIDRO, LEYTE,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated June 27, 2017 pursuant to Section 56 (c) of R.A. 7160 of the Code.

06          Presented for consideration is Ordinance No. 030-17 of the Municipality of Leyte, entitled, “AN ORDINANCE REGULATING THE USE OF PLASTIC CELLOPHANE AND SANDO BAGS AS PACKAGING MATERIALS AND UTILIZATION OF POLYSTYRENE , COMMONLY KNOWN AS STYROFOAM, FOR FOOD AND BEVERAGES CONTAINERS IN THE MUNICIPALITY OF LEYTE AND PRSCRIBING PENALTIES THEREOF,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated June 23, 2017 pursuant to Section 56 (c) of R.A. 7160 of the Code.

07         Presented for consideration is Ordinance No. 60, s-2017 of the Municipality of Villaba, Leyte, entitled, “AN ORDINANCE AMENDING SECTION 1, ARTICLE I; PARAGRAPHS B AND E, SECTION 5, ARTICLE II, PARAGRAPHS A AND C, SECTION 6, ARTICLE II; SECTIONS 7, 10 AND 11, ARTICLE III OF MUNICIPAL ORDINANCE NO. 48-2016, INCORPORATING OTHER PERTINENT PROVISIONS HEREIN AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated June 23, 2017 pursuant to Section 56 (c) of R.A. 7160 of the Code.

08        Presented for consideration is Ordinance No. 61, s – 2017 of the Municipality of Villaba, Leyte, entitled, “AN ORDINANCE PROHIBITING THE USE. SALE, DISTRIBUTION AND ADVERTISEMENT OF CIGARETTES AND OTHER TOBACCO PRODUCTS IN CERTAIN PLACES, IMPOSING PENALTIES FOR VIOLATIONS THEREOF AND PROVIDING FUNDS THEREFOR, AND FOR OTHER PURPOSES,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated June 23, 2017 pursuant to Section 56 (c) of R.A. 7160 of the Code.

09        Presented for consideration is Resolution No. 162 series of 2017 of the Municipality of Jaro, Leyte, entitled, “A RESOLUTION ADOPTING THE POLITICAL BOUNDARY SURVEY CONDUCTED BY THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR) ON JULY 3, 2015 ESTABLISHING THE CENTER LINE OF THE BINAHAAN RIVER AS THE BOUNDARIES BETWEEN BARANGAY SAN PEDRO AND BARANGAY SAN AGUSTIN AND DECLARING LOT NO. 5165, PSC-08-JARO CADASTRE ALONG THE RIVER BANK, BINAHAAN RIVER COMMONLY KNOWN AS TANGPI AREA AS WITHIN THE TERRITORIAL JURISDICTION OF BRGY. SAN AGUSTIN MUNICIPALITYF OF JARO, PROVINCE OF LEYTE, for information, guidance & references.

10          Presented for consideration is a letter dated July 3, 2017 of Mr. Edgar A. Catarongan, Regional Director, Land Transportation Office, Region VIII, respectfully requesting for a grant of lot for the establishment of its regional office in Government Center, Palo, Leyte.

 11          Presented for consideration is Resolution No. 2017-04 series of 2017 of the Provincial Land Use Committee, entitled, “RESOLUTION REQUESTING THE LOCAL GOVERNMENT UNIT (LGU) OF JARO, LEYTE TO COMPLETE AND UPDATE THE COMPREHENSIVE LAND USE PLAN (CLUP) AND ZONING ORDINANCE (ZO) OF THE MUNICIPALITY OF JARO FOR CALENDAR YEARS 2016 TO 2025 IN ACCORDANCE WITH THE 2014 GUIDELINES OF THE HOUSING AND LAND USE REGULATORY BOARD (HLURB).

 

 12           Presented for consideration is the General Fund Annual Budget CY 2017 of the Municipality of Albuera, Leyte duly enacted by the SB through Appropriation Ordinance No. 20, series of 2016 in the amount of P136,298,416.00, recommended for APPROVAL by the Local Finance Committee subject to the conditions set forth in its review letter dated June 19, 2017, together with their Annual Investment Program (AIP) CY 2017 in the amount of P831,826,616.00.

13           Presented for consideration is the General Fund Annual Budget CY 2017 of the Municipality of Abuyog, Leyte duly enacted by the SB through Appropriation Ordinance No. 03, series of 2016 in the amount of P230,591,945.00, recommended for APPROVAL by the Local Finance Committee subject to the conditions set forth in its review letter dated July 4, 2017, together with their Annual Investment Program (AIP) CY 2017.

14          Presented for consideration is a letter dated July 10, 2017 of Ms. Brenda Flores – Ampolitod General Manager LEYECO IV Hilongos, Leyte relative to the Application for the Approval by the Energy Regulatory Commission of the Power Supply Agreement (PSA) Entered Into By and Between LEYECO IV and San Miguel Energy Corporation with Prayer for the Issuance of Provisional Authority (PA), and further requesting that said Order and Notice of Public Hearing docketed as ERC Case No. 2016-213 RC be posted at the SP Bulletin Board and thereafter a Certification bearing the Dry Seal of the Office be issued as proof of posting.

15           Presented for consideration is City Ordinance No. 19 s.2017 of Baybay City, entitled, “AN ORDINANCE FIXING THE VIEWING FEES OF 16K BLOSSOMS IN LINTAON PEAK AND REGULATING ITS USE/VIEW AND OTHER PURPOSES.”

 16         Presented for consideration is City Ordinance No. 04, Series 2017 of Baybay City, entitled, “PUBLIC-PRIVATE PARTNERSHIP (PPP) ORDINANCE OF THE CITY OF BAYBAY, CREATING A PPP REGULATORY AUTHORITY, PROVIDING APPROPRIATIONS THEREOF, AND FOR OTHER PURPOSES,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017.

17           Presented for consideration is City Ordinance No. 05, Series 2017 of Baybay City, entitled, “AN ORDINANCE REGULATING THE MANUFACTURE, SALE, DISTRIBUTION AND USE OF FIRECRACKERS IN THE CITY OF BAYBAY, DESIGNATING A FIRECRACKER ZONE, PROVIDING PENALTIES THEREOF, AND FOR OTHER PURPOSES,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017.

18         Presented for consideration is City Ordinance No. 06, Series 2017 of Baybay City, entitled, “AN ORDINANCE FIXING THE GENERAL TARIFF FOR MOTOR-TRICYCLES AND ALL OTHER MOTORIZED VEHICLES, THE FRANCHISES OF WHICH ARE ISSUED BY THE CITY GOVERNMENT OF BAYBAY, PLYING THE ROUTES WITHIN THE POBLACION, EASTBOUND, SOUTHBOUND, AND NORTHBOUND, AS DEFINED UNDER THE PROVISION OF SECTION 2 OF CITY ORDINANCE NO. 07, S.2016, recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017.

19          Presented for consideration is City Ordinance No. 07, Series 2017 of Baybay City, entitled, “AN ORDINANCE ESTABLISHING A MECHANISM FOR THE DECLARATION, IMPLEMENTATION AND ENFORCEMENT OF PRE-EMPTIVE AND FORCE EVACUATION DURING DISASTER AND EMERGENCY SITUATIONS AS A LAST RESORT TO PROTECT AND SAVE LIVES AND PROVIDING PENALTY THEREOF,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017.

20          Presented for consideration is City Ordinance No. 08, Series 2017 of Baybay City, entitled, “AN ORDINANCE CREATING THE BAYBAY CITY HOUSING BOARD, DEFINING ITS POWERS AND FUNCTIONS AND PROVIDING FUNDS THEREOF,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017.

21          Presented for consideration is City Ordinance No. 09, Series 2017 of Baybay City, entitled, “AN ORDINANCE CREATING THE BAYBAY CITY RESETTLEMENT OFFICE (BCRO) DEFINING ITS POWERS AND FUNCTIONS, APPROPRIATING FUNDS THEREOF, AND OTHER PURPOSES,” recommended for the declaration of its VALIDITY by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017. 

22         Presented for consideration is Resolution No. 2017-07 of the Municipality of Palo, Leyte, entitled, “AN ORDINANCE RECLASSIFYING LOT NOS. 8437-B, 8437-C AND 8437-D CONSISTING AN AREA OF 45,795 SQUARE METERS, 29,731 SQUARE METERS AND 45,268 SQUARE METERS, RESPECTIVELY, ALL REGISTERED IN THE NAME OF OLIVIA L. CRUZ MARRIED TO VICTOR HILARION CRUZ, ALL LOCATED AT BARANGAY SAN AGUSTIN, THIS MUNICIPALITY FROM AGRICULTURAL TO RESIDENTIAL,” recommended for RETURNED to the SB of Palo, Leyte, by the Provincial Legal Office in its 2nd Indorsement dated July 5, 2017, with the opinion that the provisions of Section 20 of R.A. 7160 be complied with, together with the requirements from the Office of Department of Agrarian Reform.

23          Presented for consideration is City Ordinance No. 03 s. 2017 of Baybay City, entitled, “AN ORDINANCE RECLASSIFYING THE FOLLOWING PARCELS OF LAND, DESIGNATED AS LOT NOS. 3237, 3236 AND 3223 OF THE BAYBAY CADASTRE, CONTAINING TOTAL LAND AREA OF SEVENTY-FOUR THOUSAND SEVEN HUNDRED SIXTY-FOUR (74,764) SQUARE METERS MORE OR LESS, COVERED UNDER TCT NO. 7367 AND TCT NO. 3619, SITUATED AT BARANGAY LINTAON, THIS CITY, FROM AGRICULTURAL ZONE (AGZ) TO TOURISM DEVELOPMENT ZONE (TDZ).

24           Presented for consideration is a request for ACCREDITATION of BANGON LUNA FARMERS ASSOCIATION of Mayorga, Leyte as a Non-Government Organization of the Province of Leyte.

 25           Presented for consideration is a letter dated July 17, 2017 of Engr. FERNAN PAUL R. TAN, OIC – General Manager of LEYECO II, relative to the Application for the Approval of the Power Supply Agreement (PSA) Between the Leyte II Electric Cooperative, Inc. and San Miguel Energy Corporation with Prayer for Issuance of Provisional Authority, attached is a copy of the Order and Notice of Public Hearing dated May 23, 2017 docketed as ERC Case No. 2016-212 RC, and requests for a Certificate of Posting signed by the Vice Governor or any duly authorized representative and bearing the official seal of the office.
