04.               Presented for consideration is Municipal Ordinance No.  2024-211 of Carigara, Leyte entitled: “AN ORDINANCE RECLASSIFYING THE PARCEL OF LAND IDENTIFIED AS LOT NO. 10135, COVERED UNDER TAX DECLARATION NO. 08-110046-00395, WITH AN AREA OF 828 SQUARE METERS, OWNED BY FELIPE C. MACABANSAG, JR.; AND LOT NO. 10137, COVERED UNDER TAX DECLARATION NO. 08-11046-00232, DECLARED IN THE NAME OF JOVITO L. SUPREMO, BOTH LOCATED IN BRGY. TANGNAN, CARIGARA, LEYTE, FROM AGRICULTURAL TO RESIDENTIAL USE.” The Provincial Legal Office per 2^nd indorsement dated Dec. 26, 2024 is of the opinion that subject ordinance is within the corporate powers of the LGU covered under Sec. 447 of the Local Code, however, the power of the LGU to reclassify agricultural lands is without prejudice to the authority of the DAR to approve conversion of agricultural lands covered by RA No. 6657 to non-agricultural uses.
