06.            Presented for consideration is Municipal Ordinance  2024-193 of Carigara, Leyte entitled: AN ORDINANCE AMENDING SECTION 13 & 26 OF MUNICIPAL ORDINANCE NO. 130, SERIES OF 2022, OTHERWISE KNOWN AS A REVISED FISHERY ORDINANCE OF CARIGARA, LEYTE.  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated May 30, 2024.

07.            Presented for consideration is Municipal Ordinance No. 6 series of 2024 of Capoocan, Leyte entitled: AN ORDINANCE ADOPTING THE BANTAY ASF SA BARANGAY OR THE BABAY ASF PROGRAM IN THE MUNICIPALITY OF CAPOOCAN, LEYTE PROVIDING FOR THE CREATION OF THE MUNICIPAL ASF TASK FORCE AND PRESCRIBING THE FUNCTIONS THEREOF  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 22, 2024.

08.            Presented for consideration is Ordinance No. 8 series of 2023 of Capoocan, Leyte entitled: AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 4 S. 2021, OTHERWISE KNOWN AS, “THE MUNICIPAL FISHERY ORDINANCE OF CAPOOCAN, LEYTE.  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 16, 2024.

09.            Presented for consideration is Municipal Ordinance No. 9, series of 2024 of Capoocan, Leyte entitled: AN ORDINANCE AMENDING SECTION 10, PENALTIES, OF MUNICIPAL ORDINANCE NO. 1, SERIES OF 2019 ENTITLED “AN ORDINANCE IMPLEMENTING CURFEW HOURS ON MINORS BELOW EIGHTEEN YEARS OF AGE IN THE MUNICIPALITY OF CAPOOCAN, LEYTE  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 25, 2024.

10.            Presented for consideration is Municipal Ordinance No. 10 series of 2024 of Capoocan, Leyte entitled: AN ORDINANCE AMENDING ARTICLE E, SERVICE FEES FOR HEALTH EXAMINATION, OF MUNICIPAL ORDINANCE NO. 36, SERIES OF 2020 ENTITLED “REVENUE CODE OF THE MUNICIPALITY OF CAPOOCAN, LEYTE.”  The Provincial Legal Office has recommended that an inquiry on propriety of the rates in comparison to the 2020 Revenue Code and its basis for such amendment must be inquired upon to ensure conformity to the fundamental principles that taxes and charges must be equitable, levied and collected only for public purposes, must not be unjust, excessive, oppressive, or confiscatory, must not be contrary to law, public policy, national economic policy, or in restraint of trade as set forth, in its 2nd indorsement dated July 16, 2024.

11.            Presented for consideration is Municipal Ordinance No. 03 series of 2024 of La Paz, Leyte entitled: AN ORDINANCE ESTABLISHING GUIDELINES FOR THE DIFFERENT PROGRAMS AND SERVICES UNDER THE ASSISTANCE TO INDIVIDUALS IN CRISIS SITUATION (AICS) IN THE MUNICIPALITY OF LA PAZ, LEYTE.”  Same is recommended for the declaration of  VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 16, 2024.

12.            Presented for consideration is Municipal Ordinance No. 03 series of 2024 of Merida, Leyte entitled: AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 03, SERIES OF 2005, PRESCRIBING THERETO THE NEW TARIFF RATES ON TRICYCAD/POTPOT UNITS IN THE MUNICIPALITY OF MERIDA, LEYTE, AND IMPOSING A DAILY TERMINAL FEE THEREOF.”  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated June 21, 2024.

13.            Presented for consideration is Ordinance No. 24-06 series of 2024 of Inopacan, Leyte entitled: ECOLOGICAL SOLID WASTE MANAGEMENT ORDINANCE, DECLARING CERTAIN ACTS PROHIBITED AND PROVIDING PENALTIES AND FOR OTHER PURPOSES  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 8, 2024.

14.            Presented for consideration is Ordinance No. 24-07 series of 2024 of Inopacan, Leyte entitled: AN ORDINANCE ON WETLAND CONSERVATION AND WISE USE OF WETLAND RESOURCES DECLARING PROHIBITIONS AND PENALTIES, AND FOR OTHER PURPOSES.”  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 8, 2024.

15.            Presented for consideration is Ordinance No. 24-09 of Inopacan, Leyte entitled : “AN ORDINANCE AMENDING ORDINANCE NO. 23-14 OF THE SANGGUNIANG BAYAN OF INOPACAN, LEYTE DATED OCTOBER 17, 2023 AND APPROVING THE LOAN AGREEMENT, ASSIGNMENT AND OTHER SUPPORTING DOCUMENTS PERTAINING TO THE LOAN/CREDIT FACILITY ENTERED INTO BY AND BETWEEN THE MUNICIPAL GOVERNMENT OF INOPACAN, LEYTE REPRESENTED BY THE MUNICIPAL MAYOR, HON. ROGELIO D. PUA, JR. AND THE LANDBANK OF THE PHILIPPINES REPRESENTED BY THE HEAD OF THE SOUTHERN LEYTE LENDING CENTER, FOR THE“ REHABILITAION OF INOPACAN WATER SYSTEM FROM THE PREVIOUS OF ACQUIRING 1 UNIT WHEEL TYPE BACKHOE EXCAVATOR, IN THE AMOUNT OF 14.7 MILLION PESOS AND TO BE SECURED BY THE DEED OF ASSGNMENT OF 20% NTA, SUBJECT TO ALL LAWS, RULES AND REGULATION”

16.            Presented for consideration is Municipal Ordinance No. 01 series of 2024 of Matalom, Leyte entitled: AN ORDINANCE INTEGRATING AND HARMONIZING ALL PERTINENT ORDINANCES RELATING TO FISHERIES AND PROTECTION OF THE MUNICIPAL WATERS AND COASTAL RESOURCES OF MATALOM, LEYTE, AND FOR OTHER PURPOSES, OTHERWISE KNOWN AS THE COASTAL RESOURCE MANAGEMENT CODE OF MATALOM LEYTE 2024.”  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 18, 2024.

17.            Presented for consideration is Municipal Ordinance No. 02 series of 2024 of Matalom, Leyte entitled: AN ORDINANCE AMENDING SECTION 6, 8, 11, 13, 17 AND 36 OF MUNICIPAL ORDINANCE NO. 03-2020, AN ORDINANCE ENACTING THE LOCAL CODE FOR CHILDREN’S WELFARE OF MATALOM, LEYTE.  Same is recommended for the declaration of VALIDITY by the Provincial Legal Office per 2nd indorsement dated July 15, 2024.

18.            Presented for consideration is a copy of Notice of Appeal and Appeal Memorandum submitted by Appellant Rameil B. Cornejo of Tanauan, Leyte relative to Case No. 2024-01  filed before the Sangguniang Bayan of Pastrana, Leyte against Respondent-Appellee Carlo A. Enales, Brgy. Kagawad, Brgy. Aringit, Pastrana, Leyte.

19.            Presented for consideration is a copy of Urgent Motion to Reset initial Hearing from the Energy Regulatory Commission relative to the Application for Approval of the Emergency Power Supply Agreement between Energy Development Corp. and Leyte V Electric Cooperative Inc., with Motion for Confidential Treatment of Information. ERC CASE NO. 2024-045 RC.

20.            Presented for consideration is a letter dated July 01, 2024 from the National Water Resources Board, DENR, requesting for the posting of a Water Permit Application filed by Baybayon ni Agalon located at  Malitbog, Poblacion, Albuera, Leyte. A certification for said posting is also requested.

21.            Presented for consideration is  a letter dated July 26, 2024 to the Honorable   Vice Governor Leonardo M. Javier, Jr. from Miguel Lorenzo S. De Vera, Vice President, Energy Development Corp.,  , furnishing  copy of the Application for Authority to Develop, Own, and Operate dedicated point-to-point Limited Transmission facilities to connect the Tongonan Battery Energy Storage System Project to the Visayas Grid, with Motion for Provisional Authority and for Confidential Treatment of Information. A certification from the SP Office that above documents have been received by the same.

22.            Presented for consideration is the General Fund Supplemental Budget No. 1 CY 2024 of Carigara, Leyte amounting to Php47,814,224.95 under Appropriation Ord. No. 2024-205. Same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated July 25, 2024, together with FY 2024 Supplemental   Investment Program (SIP)in the amount of Php97,258,000.00.

Presented for consideration are Resolutions from the Provincial Health Board, to wit:

23.            A Resolution Approving the Adoption and Implementation of the Provincial Health Facility Development Plan pursuant to the Objective of RA 11223, Otherwise known as Universal Health Care act, to Provide the Filipinos Access to Quality Health Services;

24.            A Resolution Approving the Local Investment Plan for Health (LIPH) 2023-2025 and the Adoption of the Annual Operation Plan (AOP) 2023 as the Strategic and Investment Plan for Health of the Province-Wide Health System (PWHS) in the Province of Leyte;

25.            A Resolution Approving the Adoption of the 2024 Annual Operation Plan as the Strategic and investment Plan for Health of the Province-Wide Health Systems (PWHS) in the Province of Leyte; and
