                  PROPOSED PROVINCIAL ORDINANCE NO. 2024-___

AN ORDINANCE PROHIBITING THE USE, SALE, DISTRIBUTION, AND ADVERTISEMENT OF CIGARETTES, TOBACCO PRODUCTS, ELECTRONIC NICOTINE AND NON-NICOTINE DELIVERY SYSTEMS,  HEATED TOBACCO PRODUCTS, AND OTHER NOVEL TOBACCO PRODUCTS IN DESIGNATED AREAS, IMPOSING PENALTIES FOR VIOLATIONS, ALLOCATING FUNDS FOR IMPLEMENTATION, AND PROMOTING HEALTH CONSCIOUSNESS AND OTHER RELATED OBJECTIVES.”

01.               Presented for consideration is General Fund Supplemental Budget No. 3 FY 2024 of Babatngon, Leyte in the amount of Php7,639,592.48 under Appropriation Ordinance No. 475; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 26, 2024, together with Supplemental Investment Program (SIP) No. 3 CY 2024 amounting to Php30,000,000.00.

02.               Presented for consideration is General Fund Supplemental Budget No. 3 CY 2024 of Dulag, Leyte in the amount of Php10,819,415.01 under Appropriation Ordinance No. 2024-III; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 26, 2024, together with 2024 Supplemental Investment Program of the same amount.

03.               Presented for consideration is General Fund Supplemental Budget No. 02 FY 2024 of Barugo, Leyte in the amount of Php9,378,472.17 under Appropriation Ordinance No. 021, S. 2024; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 25, 2024, together with Supplemental Investment Program (SIP) No. 02 CY 2024 amounting to Php9,975,972.17.

04.               Presented for consideration is General Fund Supplemental Budget No. 05 FY 2024 of Burauen, Leyte in the amount of Php9,283,186.00 under Appropriation Ordinance No. 2024-06; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 25, 2024, together with Supplemental Investment Program (SIP) No. 04-B for CY 2024 of the same amount.

05.               Presented for consideration is General Fund Supplemental Budget No. 2 CY 2024 of Dulag, Leyte in the amount of Php59,740,991.32 under Appropriation Ordinance No. 2024-II; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 25, 2024, together with CY 2024 Supplemental Annual Investment Program of the same amount.

06.               Presented for consideration is General Fund Supplemental Budget No. 02 FY 2024 of Bato, Leyte in the amount of Php8,914,294.00 under Appropriation Ordinance No. 2024-04; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 25, 2024, together with Supplemental Investment Program  No. 2 CY 2024 amounting to Php27,009,299.80.

07.               Presented for consideration is General Fund Annual Budget  CY 2025 of Palompon, Leyte in the amount of Php355,621,802.00 under Appropriation Ordinance No. 493-300924; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 25, 2024, together with Annual Investment Program (AIP)  CY 2025 amounting to Php534,829,288.56.

08.               Presented for consideration is General Fund Annual Budget  FY 2025 of Villaba, Leyte in the amount of Php236,150,372.00 under Appropriation Ordinance No. 02, S. 2024; same is recommended for APPROVAL with CONDITIONS by the Local Finance Committee per review letter dated November 25, 2024, together with Annual Investment Program (AIP)  CY 2025 amounting to Php536,304,663.00.

09.               Presented for consideration is a copy of a letter dated November 18, 2024 from Dr. Allan L. Laniba, Gen. Manager, LEYECO III, furnishing copy of LEYECO III and SUAL POWER INC (SPI)’s Joint Application for Approval of the Power Supply Agreement between LEYECO III and Sual Power Inc. (SPI), with Motion for Confidential Treatment of Information and Prayer for Provisional Authority and/or Interim Relief. With request for Certification bearing the dry seal of SP Office confirming the receipt of the documents.

10.               Presented for consideration is Ordinance No. 478 of Babatngon, Leyte entitled: AN ORDINANCE ADOPTING THE PALENG QR PH PROGRAM IN THE MUNICIPALITY OF BABATNGON, LEYTE.” Same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

11.               Presented for consideration is Ordinance No. 480 of Babatngon, Leyte entitled: AN ORDINANCE PROHIBITING ACTS OF ONLINE SEXUAL ABUSE AND EXPLOITATION OF CHILDREN (OSAEC)
IN THE MUNICIPALITY OF BABATNGON, LEYTE WITH CORRESPONDING PENALTIES, THEREAFTER PROVIDING A SUPPORTIVE ENVIRONMENTFOR THE SURVIVORS, AND PROVIDING FUNDS THEREOF.”
 same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

12.               Presented for consideration is Ordinance No. 2024-18 of Tanauan, Leyte entitled: AN ORDINANCE ESTABLISHING THE KASALAN NG BAYAN PROGRAM IN THE MUNICIPALITY OF TANAUAN, LEYTE.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

13.               Presented for consideration is Municipal Ordinance No. 24-12 series of 2024 of Burauen, Leyte entitled: AN ORDINANCE INSTITUTIONALIZING THE ANNUAL “KASALAN NG BAYAN”, EVERY MONTH OF FEBRUARY OF THE MUNICIPAL GOVERNMENT OF BURAUEN, LEYTE, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

14.               Presented for consideration is Municipal Ordinance No. 24-13 series of 2024 of Burauen, Leyte entitled: AN ORDINANCE INSTITUTIONALIZING THE “ANNUAL CIVIC ACTION (CIVAC) PROGRAM: LOCAL  SERBISYO CARAVAN” OF THE MUNICIPAL GOVERNMENT OF BURAUEN, LEYTE, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

15.               Presented for consideration is Municipal Ordinance No. 24-14 series of 2024 of Burauen, Leyte entitled: AN ORDINANCE AMENDING THE TITLE AND SECTIONS 2, 3, 4, AND 5 OF MUNICIPAL ORDINANCE NO. 24-05, SERIES OF 2024 WHICH IS  “AN ORDINANCE DECLARING NORBERTO L. ROMUALDEZ, SR. AS A LOCAL HERO OF THE MUNICIPALITY OF BURAUEN, LEYTE, AND DECLARING EVERY 6TH DAY OF JUNE AS A SPECIAL WORKING HOLIDAY TO COMMEMORATE HIS BIRTH.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

16.               Presented for consideration is Municipal Ordinance No. 24-19 series of 2024 of Burauen, Leyte entitled: AN ORDINANCE MANDATING ALL BUSINESSES OPERATING WITHIN THE TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF BURAUEN, LEYTE ENGAGED IN THE MANUFACTURE, SALE, OR DISTRIBUTION OF PNP UNIFORMS, INSIGNIAS, AND OTHER ACCOUTREMENTS TO SECURE PNP CERTIFICATE OF CONFORMITY AND PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

17.               Presented for consideration is Municipal Ordinance No. 2024-127 of Mayorga, Leyte entitled: AN ORDINANCE PUNISHING ONLINE SEXUAL ABUSE AND EXPLOITATION OF CHILDREN, PENALIZING THE PRODUCTION, DISTRIBUTION, POSSESSION AND ACCESS OF CHILD SEXUAL ABUSE AND EXPLOITATION MATERIALS IN THE MUNICIPALITY OF MAYORGA, LEYTE.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

18.               Presented for consideration is Ordinance No.  2024-23 of Calubian, Leyte entitled: AN ORDINANCE REGULATING THE HOLDING OF DISCOS AND BENEFIT DANCES.” with opinion from the  Provincial Legal Office per 2nd indorsement dated November 15, 2024 that the penal provisions of the proposed ordinance under Sec. 4 are in contravention with Sec. 447(a)(1)(iii)of the same Local Government code. Hence, review of the proposed ordinance is recommended.

19.               Presented for consideration is Ordinance No.  2024-24 of Calubian, Leyte entitled: AN ORDINANCE AMENDING SECTION 5A.07 OF MUNICIPAL ORDINANCE NO. 2023-01 ENTITLED, “AN ORDINANCE REVISING THE MUNICIPAL REVENUE CODE OF CALUBIAN, LEYTE.” with opinion by the  Provincial Legal Office per 2nd indorsement dated November 15, 2024 that the subject amendment is in contravention with Sec. 447 (a) (iii) of the local Government Code, hence FURTHER REVIEW is recommended.

20.               Presented for consideration is Municipal Ordinance No.  2024-09 of Tabango, Leyte entitled: AN ORDINANCE CREATING THE POSITIONS UNDER THE MUNICIPAL SOCIAL WELFARE AND DEVELOPMENT OFFICE AND THE MUNICIPAL CIVIL REGISTRAR OFFICE IN THE MUNICIPAL GOVERNMENT OF TABANGO, PROVINCE OF LEYTE, PROVIDING FOR ITS QUALIFICATIONS, DUTIES, AND FUNCTIONS AND APPROPRIATING FUNDS THEREOF.” same is recommended for the declaration of its VALIDITY  by the  Provincial Legal Office per 2nd indorsement dated November 15, 2024.

21.               Presented for consideration is Ordinance No. 23L.24-058 series of 2024 of Kananga, Leyte entitled: AN ORDINANCE ADOPTING A LOCAL GOVERNMENT ENERGY CODE TO PROMOTE ENERGY EFFICIENCY AND CONSERVATION, FACILITATE THE IMPLEMENTATION OF ENERGY PROJECTS, HARMONIZE LOCAL AND NATIONAL POLICIES ON ENERGY UTILIZATION, EFFICIENCY, SAFETY, RESILIENCE AND DEVELOPMENT, AND FOR SUCH OTHER RELATED PURPOSES, AND PROVIDING FUNDS THEREFOR.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

22.               Presented for consideration is Municipal Ordinance No. 01 series of 2024 of Merida, Leyte entitled:AN ORDINANCE MANDATING BUSINESS ESTABLISHMENTS OPERATING WITHIN THE TERRITORIAL JURISDICTION OF MERIDA, LEYTE TO INSTALL A CLOSED-CIRCUIT TELEVISION (CCTV) SYSTEM AND PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

23.               Presented for consideration is Municipal Ordinance No. 07 series of 2024 of Merida, Leyte entitled: AN ORDINANCE PRESCRIBING FEES AND CHARGES FOR THE SERVICES AND USE OF FACILITIES OF THE MERIDA BIRTHING CLINIC OF MERIDA,LEYTE.” same is recommended for the declaration of its VALIDITY by the Provincial Legal Office per 2nd indorsement dated November 15, 2024.

24.               Presented for consideration is a request for Accreditation of C.I.A. – Citizen’s Information and Assistance, Inc. of Zone 6, Brgy. 110, Utap, Tacloban City with the Provincial Government of Leyte as a non-government organization.

25.               Presented for consideration is a request for Accreditation of GUINDAPUNAN EAST YOUTH ORGANIZATION of Guindapunan East, Carigara, Leyte with the Provincial Government of Leyte as a non government organization.
